High Court Bench settles Biryani brand case


Chennai, Nov 19 : A Division Bench of Madras High Court had to step in to resolve a row between two restaurants over the brand name of biryani being served on their menu.

The dispute arose when the nearly century old Dindigul-based ''Thalapakatti Naidu Ananda Vilas Biryani Hotel'', selling biryani with the brand name ''Thalapakattu Biryani'', objected to a city based ''Thalapakattu Biryani and Fast Food'' also selling biryani with the same brand name.

When the Dindigul based restaurant moved the High Court, a single Judge restrained the city based company from using the brand name.

Following this the latter filed an appeal.

Disposing of the appeal, the Bench, comprising Justices P K Misra and A Kulasekaran worked out a solution under which, it directed the city based company to brand its Biryani as ''Chennai Rawther Thalapakattu Biryani''.

Stating that it was purely an interim order, the Bench directed the single Judge to dispose of the case on merits, preferably within a period of three months.
